Terms & Conditions

  1. Introduction 1.1. These terms and conditions (hereinafter referred to as “Agreement”) govern the sale and purchase of real estate located in the state of Florida (the “Property”) between the seller (the “Seller”) and the buyer (the “Buyer”). These terms and conditions are binding upon both parties.
  2. Sale of Property 2.1. The Seller agrees to sell, and the Buyer agrees to purchase, the Property for the agreed-upon cash purchase price, which shall be specified in a separate purchase agreement or contract (the “Contract”).
  3. Closing 3.1. The closing date for the sale of the Property shall be as set forth in the Contract. 3.2. The closing shall take place at a mutually agreed-upon location and shall be conducted in accordance with Florida real estate law.
  4. Title and Inspection 4.1. The Seller shall provide a marketable title to the Property, free and clear of all liens and encumbrances, except as otherwise specified in the Contract. 4.2. The Buyer shall have the right to inspect the Property and conduct any necessary due diligence, as outlined in the Contract.
  5. Earnest Money 5.1. The Buyer may be required to provide earnest money as specified in the Contract. The earnest money shall be held in escrow and applied toward the purchase price at closing.
  6. Contingencies 6.1. The sale of the Property may be contingent upon certain conditions as specified in the Contract, such as financing, inspections, or appraisals.
  7. Closing Costs 7.1. The parties shall be responsible for their respective closing costs, as specified in the Contract.
  8. Default 8.1. In the event of a default by either party, the remedies and consequences shall be outlined in the Contract, which may include forfeiture of earnest money, legal action, or specific performance.
  9. Communication Consent and Marketing 9.1. By entering into this Agreement, both parties consent to receiving text messages and phone calls related to the sale of the Property. Additionally, the Buyer acknowledges consent to receive marketing communications, including updates on real estate services and promotions. Opting out of marketing communications can be done by contacting the Seller.
  10. Governing Law 9.1. This Agreement is governed by and construed in accordance with the laws of the state of Florida.
  11. Entire Agreement 10.1. This Agreement, along with the Contract, constitutes the entire agreement between the parties and supersedes all prior or contemporaneous negotiations, understandings, and agreements.
  12. Amendment 11.1. Any amendments or modifications to this Agreement must be in writing and signed by both parties.
  13. Legal Advice 12.1. Both parties acknowledge that they have had the opportunity to seek legal counsel to review and explain the terms of this Agreement.
